Welcome to MXEats. These Terms and Conditions (“Terms”) govern your access to and use of the MXEats website, mobile application, and related services (collectively, the “Platform”). By accessing or using MXEats, you agree to be bound by these Terms. If you do not agree, you must refrain from using the Platform.
 

1. Definitions

  • “MXEats” refers to the food ordering and delivery platform operated by MXEats.

  • “User” refers to any individual who accesses or uses the Platform.

  • “Restaurant Partner” refers to third-party restaurants listed on MXEats.

  • “Delivery Partner” refers to third-party delivery service providers.

  • “Services” refers to food ordering, delivery, pickup, and related services offered through the Platform.

2. Eligibility

You must be at least 18 years of age or capable of entering into a legally binding contract under applicable law to use MXEats. By using the Platform, you represent and warrant that you meet these requirements.

3. Account Registration

  • Users may be required to create an account to place orders.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You agree to provide accurate, current, and complete information.

  • MXEats reserves the right to suspend or terminate accounts providing false or misleading information.

4. Use of the Platform

You agree to use MXEats only for lawful purposes. You shall not:

  • Misuse the Platform or interfere with its operation.

  • Attempt unauthorized access to any part of the Platform.

  • Use the Platform for fraudulent or harmful activities.

 

5. Orders and Payments

  • All orders placed through MXEats are subject to acceptance by the respective Restaurant Partner.

  • Prices, availability, and menu items are determined by Restaurant Partners and may change without notice.

  • Payments must be made through approved payment methods available on the Platform.

  • MXEats is not responsible for pricing errors, though reasonable efforts will be made to rectify them.

6. Cancellations and Refunds

  • Cancellation and refund policies may vary based on the Restaurant Partner and order status.

  • Once an order is prepared or dispatched, cancellation may not be permitted.

  • Refunds, if applicable, will be processed according to MXEats’ refund policy and applicable laws.

7. Delivery

  • Delivery times are estimates and may vary due to traffic, weather, or other circumstances.

  • MXEats shall not be liable for delays beyond reasonable control.

  • Users must ensure accurate delivery details are provided.
